Emergency appeal in Hamtramck, Mich., mayor's race goes to state Supreme Court

DETROIT - The lawyer for the Hamtramck mayoral candidate who lost by 11 votes is making an emergency... Mark Brewer, the lawyer for the Hamtramck mayoral candidate who lost by 11 votes, is appealing to the Michigan Supreme Court against a Wayne County judge's decision to dismiss 37 absentee ballots that were not counted. This could potentially overtake City Council member Muhith Mahmood's narrow victory. The uncounted ballots were found in the Hamdramck clerk's office the day after the election. Hamdremck City Clerk Rana Faraj discovered them and delivered them to the Wayne County Board of Canvassers, but other people had been in her office between election night and their discovery. Brewer argues that the ruling doesn't properly consider Michigan case law that mistakes made by election officials can't disenfranchise voters. Alharbi's attorney, Nubihad, has also sued Mahmood, claiming his opponent is not eligible to hold office in the city.
